Terms of Service

These Terms of Service ("Terms") govern your use of the Nuzetta NDIS plan management platform. By creating an account or using our services, you agree to be bound by these Terms. Please read them carefully.
1. About Nuzetta
Nuzetta is an NDIS-registered plan management provider operating in Australia. We provide:
- Invoice processing and payment services for NDIS participants
- Budget tracking and reporting tools
- Compliance management for providers and plan managers
- A platform for participants to view their NDIS plan utilisation
We operate under the NDIS Act 2013 (Cth), the NDIS Quality and Safeguards Commission framework, and all applicable Australian legislation.
2. Eligibility & Account Creation
- You must be at least 18 years old to create an account (or have a guardian/representative act on your behalf)
- NDIS participants must have an active NDIS plan with plan management funding allocated
- Providers must hold a current ABN and comply with applicable NDIS registration requirements
- You are responsible for maintaining the security of your account credentials
- You must not share your login credentials with others
3. Provider Obligations
If you use Nuzetta as an NDIS support provider, you agree that:
- All invoices submitted are for services that were actually delivered to the participant
- Services were delivered at the rates specified in the NDIS Pricing Arrangements and Price Limits
- You hold all required insurance, qualifications, and NDIS registrations for the services provided
- You will maintain valid worker screening clearances for all staff providing NDIS supports
- You will not submit duplicate invoices
- Invoice fraud is a criminal offence and will be reported to the NDIS Commission and police
⚠️ Submitting false or fraudulent invoices is a serious offence under the NDIS Act and Australian criminal law. Nuzetta maintains audit trails and reports suspected fraud.
4. Invoice Processing
- Nuzetta processes invoices within 24-48 business hours of submission
- Payment is subject to NDIS plan manager approval and available plan funds
- Nuzetta is not liable for delays caused by insufficient plan funds, NDIS portal outages, or banking processing times
- You may appeal rejected invoices via the complaints process within 30 days of rejection
- Nuzetta reserves the right to place invoices on hold pending verification if fraud is suspected
5. Plan Manager Responsibilities
If you use Nuzetta as a plan manager, you are responsible for:
- Reviewing and approving invoices promptly and in accordance with the participant's NDIS plan
- Ensuring that invoices align with the participant's funded supports and NDIS price guide
- Maintaining participant records and consents in accordance with NDIS legislation
- Reporting overbudget situations to the participant promptly
- Cooperating with NDIS Commission audits and compliance reviews
6. Acceptable Use
You agree not to:
- Submit fraudulent, duplicate, or inflated invoices
- Access another user's account without authorisation
- Attempt to circumvent security controls or access controls
- Use the platform for any unlawful purpose
- Scrape, harvest, or systematically extract data from the platform
- Upload malicious code or attempt to disrupt the platform
Violations may result in immediate account suspension and reporting to relevant authorities.
7. Fees & Payment
Plan management fees are funded through your NDIS plan under the "Improved Life Choices" (Support Category 07) budget. Nuzetta's fees are charged in accordance with the NDIS Pricing Arrangements and Price Limits for plan management services.
We do not charge providers or participants any additional platform fees beyond the NDIS-funded plan management allocation.
8. Intellectual Property
All content, software, and materials on the Nuzetta platform are owned by or licensed to Nuzetta. You may not copy, reproduce, distribute, or create derivative works from our platform without written permission.
Your data (invoices, plan information, documents) remains yours. We hold a limited licence to process it for the purposes of providing our services.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
- Nuzetta's liability is limited to the plan management fees paid in the 3 months prior to the claim
- We are not liable for indirect, consequential, or special damages
- We are not liable for loss of NDIS funding, plan cancellation, or NDIA decisions
- We are not liable for delays caused by third parties (banks, NDIA, NDIS portal)
Nothing in these terms limits liability for fraud, personal injury, or rights that cannot be excluded by law.
10. Termination
Either party may terminate the plan management arrangement by providing 2 weeks' written notice. In the event of a serious breach (fraud, criminal conduct), Nuzetta may terminate immediately without notice.
Upon termination, we will provide a final statement and transfer records to your new provider within 30 days.
11. Disputes & Complaints
If you have a complaint, please use our complaints process. We aim to resolve all complaints within 10 business days.
Unresolved disputes may be referred to the NDIS Quality and Safeguards Commission (1800 035 544) or the Australian Financial Complaints Authority (AFCA).
These Terms are governed by the laws of Queensland, Australia.
12. Changes to These Terms
We may update these Terms from time to time. We will provide 30 days' notice of material changes by email. Continued use of Nuzetta after that period constitutes acceptance.
